Lindy Herman joined Wang, Hartmann, Gibbs and Cauley, PLC as an associate in 2010. In addition to a Juris Doctorate, Ms. Herman holds certificates in Intellectual Property Law and International and Comparative Law. Ms. Herman focused her undergraduate studies in Museology and received her Bachelor of Arts in History with a Minor in French.
Prior to attending law school, Ms. Herman was the Youth Education Program Coordinator for the Museum of Tolerance in Los Angeles, California. It was during this position that she became particularly interested in international intellectual property issues related to cultural property, fine arts/artist's rights, and the international exchange of ideas. Ms. Herman is experienced in assisting clients with their domestic and international trademark portfolios including counseling on trademark availability, selection, enforcement, and handling all aspects of trademark prosecution.
Ms. Herman has resolved several U.S. and international trademark disputes including inter-parties proceedings before the U.S. Trademark Trial and Appeal Board (TTAB), domain-name disputes under the Uniform Domain-Name Dispute-Resolution Policy (UDRP), managed foreign litigation through foreign counsel, and negotiated several related settlements.
In addition to trademark matters, Ms. Herman also advises on copyright ability of client materials, has obtained several copyright registrations on behalf of her clients, and handles related intellectual property business matters such as preparing work for hire agreements, assignments, licenses, and confidentiality agreements. While in law school, Ms. Herman, earned Dean's List recognition, was awarded the CALI Award for Excellence in Trademark and Unfair Competition Law and also served as a research assistant to Professor David Welkowitz where her work on international trademark law contributed to the latest revision of his treatise Trademark Dilution: Federal, State, and International Law (BNA Books, 2005 Cumulative Supplement).
Prior to joining WHGC, Ms. Herman worked for the intellectual property boutique firms of J. Mark Holland and Associates in Newport Beach, California, and TRW Law Group in Irvine, California. Ms. Herman has also served as an Intellectual Property Consulting Attorney to local business law firms who do not have dedicated intellectual property practitioners.
While at TRW Law Group, she co-presented "The Madrid Protocol: A Five Year Report Card" to the Orange County Bar Association's Intellectual Property Section. Ms. Herman later contributed to an article expanding on the presentation, published under the same name, in Orange County Lawyer magazine.
When away from the firm, Ms. Herman enjoys attending the latest museum exhibitions and volunteers her time at a local animal shelter.
