Diane M. Barker's practice focuses on civil litigation in both California state and federal courts. She represents clients in a wide array of matters including breach of contract, patent infringement, business tort, antitrust, and unfair competition cases. Ms. Barker has experience in all aspects of litigation from pre-suit investigation to post-trial motion practice.

Ms. Barker has handled all aspects of litigation matters including case analysis (drafting internal persuasive and strategic legal memoranda), drafting discovery responses and discovery requests, deposing witnesses, attending case management, status, and discovery conferences, negotiating with opposing counsel, preparing substantive motions and sections of same (oppositions to class certification, demurrers, and motions to dismiss), as well as preparing motions in limine and procedural motions (motions to exclude expert testimony).

In addition to her extensive legal experience, Ms. Barker is a member of the Board of Directors and chairperson of the Advisory Board for the Homeless Children's Network. In this leadership role, she works with the Executive Director and other board members to evaluate budget proposals and make strategic policy decisions.

Notable Cases

Some of Ms. Barker's representative matters include defending a multinational corporation against unfair competition allegations in the mobile wireless industry; defending against allegations of antitrust violations under Section 2 of the Sherman Act in the context of standard setting organizations; defending against putative direct and indirect purchaser class actions which alleged price fixing under Section 1 of the Sherman Act; and defending against over 75 alleged class-action lawsuits claiming monopolization in the microprocessor industry.

Pro-Bono Work

Porter v. Speirs, a tax payer action to improve the practices and conditions within the juvenile detention facilities operated by the Sacramento County Probation Department.
