Copyrights: Protect your Work

Copyright provides protection for the expression of written, musical, pictorial and other methods of creative expression, such as a pictures, novels, songs, etc. Copyright registration is filed with the Library of Congress in Washington, D.C. . The Berne Convention of 1989 grants copyrights to original artwork without filing for registration. In order to litigate on a copyright, the copyright must be registered. The attorneys at Wang, Hartmann, Gibbs & Cauley are experienced and qualified to protect the copyright work of its clients through registration and litigation.

Associate Your Product With A Mark And Sell More

A trademark is a way to associate goods with a service. Trademarks connect a word or symbol with a product. For example, the Nike “swoosh” or the Starbucks logo. The court places limitations on trademarks, so its important to have a skilled and qualified attorney on your side. We trademark words and symbols which uniquely signify our client.

A trade dress is a type of trademark that relates to the packaging or nonfunctional design of a product, that carries with it "inherent distinctiveness" that creates recognition of a company or a product. An example would be the packaging of a McDonald’s Happy Meal or the square bottle and blue cap of a Fiji water bottle. At Wang, Hartmann, Gibbs & Cauley, P.C., we are experienced in filing distinct and successful trade dress applications that directly reflect the thoughts and ideas of our client.

Patents: Defend Your Exclusive Designs

A patent gives you the right to exclude others from using your invention. Our attorneys are experienced handling all types of patents, including patents for complex hardware and software inventions. There are two types of patents:

  • Design patent: A design patent gives you rights on the appearance of a product or layout, such as placement of the parts of a cell phone (display screen, logo, buttons, etc.) or the shape/size, design, of head and tail lights on an automobile.
  • Utility patent: A utility patent gives you rights on an actual product (pen, cell phone, etc.), not the layout or look of it.

Patents are granted by the United States Patent and Trademark Office, though determinations of patent validity and infringement are the exclusive jurisdictions of the United States District Courts.
